“No Tolerance” Policy Regarding Fraudulent or Obscene Postings

PLEASE READ CAREFULLY:
Talktag.com’s web site strictly adheres to a policy of prohibition against the posting of fraudulent, pornographic, obscene, or otherwise defamatory material.
Definitions:
For the purpose of this policy, the terms “pornography” and “obscene” shall be defined according to statute, as enacted by both Federal and Louisiana legislatures, and interpreted by the United States Supreme Court. For the specific purposes of the Talktag.com web site, the definitions of “pornography “ and “obscenity” include, but are not limited to: foul language, all sexual content, and racial epithets. “Fraudulent” material is defined as that which is made with the intent to deceive Talktag.com users and the general public. “Defamatory” material is intentionally false information that injures another’s reputation or good name.
Civil Liability For Persons Violating Our Policy:
Any person posting such material, defined above, to the Talktag.com web site, (“Poster”), assumes sole civil and moral liability for the results of such a posting. Any person posting such material, defined above, also agrees to defend and indemnify Talktag.com for any and all claims which may arise as a result of said Poster’s intentional or negligent acts. Talktag.com further reserves the right to pursue such Posters, their parents, or their legal guardians, individually for civil damages.
Persons Violating Our Policy Voids Their Contract With Activity Seeker, L.L.C.:
By posting such material, as describe above, said Poster makes null and void any user agreements previously entered into between himself and Talktag.com. Talktag.com, further reserves the right to refuse additional access to the Talktag.com web site to any individual or group who posts such material as described above.
Criminal Prosecution:
Additionally, any person posting such material, defined above, will be reported to local or state authorities for prosecution to the fullest extent of the law. By posting such material, described above, said Poster agrees to waive any right to privacy previously guaranteed to Poster by Talktag.com for any user information gathered on Poster by Talktag.com. Talktag.com will fully cooperate in allowing law enforcement agencies to review their personal information as it is necessary.
Appellate Procedure For “Questionable Listings”:
Talktag.com has a procedure in place for direct review of any material posted which is refused by the system, and which the poster believes was refused on the basis that it does not meet any of the definitions listed above.
